The following information bulletin is in accordance with Canadian Nuclear Laboratories’ (CNL) ongoing commitment to voluntary public disclosure of events related to the Chalk River Laboratories site.
Chalk River, ON – June 1, 2026 – Late last week, CNL’s appeal to the Federal Court of Appeal regarding the Federal Court’s decision (T-647-24) related to Environment and Climate Change Canada’s (ECCC) approval of a Species At-Risk Act (SARA) permit in relation to the construction of a Near Surface Disposal Facility (NSDF) at Chalk River Laboratories was dismissed.
Through the appeal, CNL sought to obtain clarity in a complex regulatory environment as we work to responsibly address Canada’s legacy nuclear liabilities and minimize their impacts on the environment.
CNL respects the decision of the court and is now taking time to evaluate the decision.
CNL remains committed to protecting the environment and species at-risk – restoration and protection of the environment is at the core of our work. CNL firmly believes in the science that is behind our proposal, which is the culmination of almost a decade of study, federal and provincial review, and engagement with Indigenous communities, the public and other interested parties. These studies of our sites, including monitoring, tracking, and understanding the impacts of our operations on the environment, including biodiversity and habitat, continue today.
CNL will continue efforts to minimize the environmental impacts of these historic nuclear liabilities until a permanent solution is in place.
